Sol'eil House is powered by Shopify, which enables us to provide the Services to you.

When you place an order, you are making an offer to purchase. Sol'eil House reserves the right to accept or decline your order for any reason, at its sole discretion, without liability. Your order is not accepted until Sol'eil House explicitly confirms acceptance. We must receive and successfully process your payment before your order is accepted.
All orders are final once accepted. Please review your order carefully before submitting. Sol'eil House will not accommodate cancellation requests after an order has been accepted, except as required by applicable law.
In the event that we do not accept, modify, or cancel an order, we will attempt to notify you using the contact information provided at checkout. Sol'eil House assumes no liability for failure to reach you using that information.
All purchases are subject to our Return & Refund Policy. You represent and warrant that your purchases are for personal or household use only and not for commercial resale or export.

Prices, discounts, and promotions are subject to change at any time without notice. The price charged for a product will be the price in effect at the time the order is placed, as set out in your order confirmation. Sol'eil House reserves the right to refuse or cancel any order suspected of fraud, unauthorized use, or any other reason at its sole discretion.
SECTION 5 — SHIPPING AND DELIVERY
All delivery timeframes provided are estimates only and are not guaranteed. Sol'eil House is not liable for any shipping or delivery delays, regardless of cause, including delays attributable to carriers, customs processing, weather events, or any other circumstances beyond our control.
Once an order is transferred to the carrier, title and risk of loss pass entirely to the customer. Sol'eil House bears no responsibility for packages lost, stolen, delayed, or damaged after handoff to the carrier. It is the customer's sole responsibility to ensure their delivery address is accurate and complete prior to placing an order. Sol'eil House is not responsible for orders shipped to incorrectly provided addresses and will not issue refunds or replacements in such cases.

Sol'eil House is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Sol'eil House. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Sol'eil House, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Sol'eil House.

Sol'eil House may terminate this agreement or your access to the Services at any time, without notice, at our sole discretion. You will remain liable for all amounts due up to and including the date of termination. Sections covering Intellectual Property, Feedback, Disclaimer of Warranties, Limitation of Liability, Indemnification, Governing Law, and any provisions that by their nature should survive termination will continue to apply.

EXCEPT AS EXPRESSLY STATED BY SOL'EIL HOUSE, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT ANY REPRESENTATION, WARRANTIES, OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW THE DISCLAIMER OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

TO THE FULLEST EXTENT PERMITTED BY LAW, SOL'EIL HOUSE, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING WITHOUT LIMITATION LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, OR REPLACEMENT COSTS, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCTS PROCURED THROUGH THE SERVICES. IN NO EVENT SHALL SOL'EIL HOUSE'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES EXCEED THE AMOUNT YOU PAID TO SOL'EIL HOUSE IN THE THREE (3) MONTHS PRECEDING THE CLAIM.
SECTION 18 — INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Sol'eil House, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from and against any losses, damages, liabilities, and claims, including reasonable attorneys' fees, arising out of: (1) your breach of these Terms; (2) your violation of any law or the rights of a third party; or (3) your access to or use of the Services. Sol'eil House reserves the right to assume exclusive control of the defense of any indemnifiable claim at your expense.

You may not delegate, transfer, or assign these Terms or any of your rights or obligations hereunder without our prior written consent; any such attempt will be null and void. Sol'eil House may transfer, assign, or delegate these Terms and its rights and obligations without consent or notice to you.

These Terms of Service shall be governed by and construed in accordance with the laws of the jurisdiction where Sol'eil House is headquartered. You consent to the exclusive venue and personal jurisdiction of such courts for any dispute arising under these Terms. Any claim must be brought in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.
